Employment and Support Allowance (ESA)

What is Employment and Support Allowance (ESA)?

Employment and Support Allowance - sometimes referred to as ESA - is an allowance that is replacing Incapacity Benefit and Income Support paid on the basis of a disability.

Employment and Support Allowance (ESA) is either "means-tested" or "contribution based" (based on National Insurance payments).

Unlike Incapacity Benefit, Employment and Support Allowance (ESA) focuses on the type of work that you might reasonably be expected to do.

In applying for Employment and Support Allowance (ESA) , you may need to undertake an assessment during the early stages of your claim. If you pass the assessment, then you will be considered for one of two Employment and Support Allowance (ESA) components: work-related or support.

The work-related component is to help people to find employment where there is limited capability for work.

The support component is for people who would find it more difficult to find suitable employment or, in the worst case, be incapable of working at all. Serious health problems could mean that you bypass the "assessment" and go straight to the support component.

To date, it is estimated that over £7 billion in benefits goes unclaimed every year - a significant number of which should be claimed by Employment and Support Allowance (ESA) applicants.

If you, or someone you know, are experiencing difficulties, then it is important to acknowledge the problems and decide if there is eligibility to Employment and Support Allowance (ESA) .

You may be able to claim Employment and Support Allowance (ESA) if any of the following apply to you:

  • your Statutory Sick Pay has ended, or you cannot get it

  • you are self employed or unemployed

  • you have been getting Statutory Maternity Pay (SMP) and have not gone back to work for your employer because you have an illness or disability which affects your ability to work

  • you are under State Pension age.

There are other significant qualifying conditions for which it would be necessary to undertake a full review of your circumstances.

If you or someone that you know is experiencing any problems associated with any of these activities, they could be eligibility for Employment and Support Allowance (ESA) .

Can I claim Employment and Support Allowance (ESA) if I am already claiming other benefits?

Yes you can!

You can claim Employment and Support Allowance (ESA) in addition to other benefits and allowances.

Employment and Support Allowance (ESA) is either "need-based" or "contribution-based":

If the claim is "need-based", this means that the officer will check to make sure that you are receiving at least the minimum amount of income needed for a person with your circumstances.

If the claim is "contribution-based" this means that the officer will take into account National Insurance contributions paid so as to ensure that you receive what is due to you. This should allow you to continue receiving other sources of income.

With this in mind, if you have a spouse or partner, they too can claim Employment and Support Allowance (ESA) if you are both entitled to the contribution-based Employment and Support Allowance (ESA) .

To understand your full eligibility you need independent advice. For this, you need a dedicated professional to assess your complete circumstances confidentially.

Case study

Twenty-two year old Michael is single.

"Having left school, I worked in a warehouse. One day, I was very seriously injured to the extent where I can no longer raise either of my arms. I can no longer raise food to my own mouth without physical help. My employer was not obliged to award any sick-pay".

Michael knew people of his own age who were receiving Jobseekers Allowance (JSA); for which payments of only £51.85 per week were available.

Fortunately, Housing Benefit Helpline advised Michael to claim Employment and Support Allowance (ESA) and was put in touch with someone who was able to help him through the claims process.

For Michael, this means that he now receives £110.50 per week which is more than double the payment for Jobseekers Allowance (JSA).

This case study is fictitious, but helps to illustrate just some of the many ways in which Housing Benefit Helpline can help change peoples lives for the better.

Why does Employment and Support Allowance go unclaimed?

Many people who could claim Employment and Support Allowance (ESA) often do not do so. The number of people who claim for the allowance is low when compared to other benefits and allowances that are available.

So why does not everyone claim Employment and Support Allowance (ESA) ? Some of the reasons many people do not claim Employment and Support Allowance (ESA) are as follows:

  • People do not realise that they might be entitled to claim. (You do not have to be "disabled" to claim Employment and Support Allowance (ESA) !)

  • You may have been in contact with a health professional. That particular person may be inexperienced or too busy to assess your Employment and Support Allowance (ESA) claim accurately, so may not be able to give you the best advice. This may lead to an unfair refusal, a reduced payment or wrong advice which may stop some genuine applicants starting their initial application

  • Patients' lack of awareness about benefits to which they may be entitled or how to claim them

  • Claim forms can be lengthy and complicated. This can lead to a form being completed incorrectly or, in the worst case, not at all

  • Staff at the DWP (previously known as DHSS/DSS) might have limited understanding about how you (or someone you know) are actually feeling

  • A health condition can make it impractical and/or uncomfortable. It can even stop a person from making a claim for Employment and Support Allowance (ESA) . For example, a course of antibiotics or antidepressants can sometimes leave a claimant not in the best frame of mind to be completing a claim form adequately.

  • You may feel uncomfortable about having to undertake a medical examination as part of a "Work Capability Assessment".

What if I have been refused Employment and Support Allowance (ESA)?

Due to the inefficiencies of certain "officials" it has been known for refusals to be over-turned when the claim has been re-presented in a professional and methodical manner (i.e. by a professional company or consultant).

Many times, the refusal decision is based on an incorrect presentation of certain information by the claimant or by an incorrect assessment from the particular benefits office/r in question.

We have found 40% or more of "refused claims" have a very good chance of being overturned.

Needless to say, this issue is very important.

Full claim acceptance not only over-turns a previous refusal, but it also means you will probably be eligible for back-payments from the point of an initial claim.

This alone could often lead to thousands of pounds in back-payments due to you.
