Who is eligible for Bereavement Payment? Bereavement Payment is possible if your husband, wife, or civil partner who has died paid enough national insurance contributions. If the death was caused by an industrial accident or an industrial disease, it does not matter whether they paid enough contributions or not.
To see if you qualify for Bereavement Payment, there are some conditions that you need to be aware of: -
- Normally, you must have been below state pension age when your husband, wife or civil partner died,
- If you were over pension age - they must not have been entitled to state retirement pension, based on their own national insurance contributions, when they died.
- You must have been married to your husband or wife or in a registered civil partnership with your partner when they died.
- Until 6 April 2010, pension age was 60 for a woman and 65 for a man. This changed from 6 April 2010 because the age difference between men and women is gradually being equalised and the retirement age for both men and women is gradually being increased.
If you want to check when you will reach state pension age, there is a state pension age calculator on the Directgov website.
- You must claim within twelve months of your spouse or civil partners death. If you could not claim within this time because you did not know your spouse or civil partner was dead or it had not been confirmed, it may be possible to make a late claim.
Coping with a death involves many practical issues. This, combined with emotional distress, can be overwhelming.
If you or someone that you know has experienced bereavement, there could be eligibility for a Bereavement Payment. An improved financial situation could provide a practical source of help at a time of great distress.

Why does Bereavement Payment go unclaimed? Many people who could claim Bereavement Payment often do not do so. Some of the reasons many people do not claim Bereavement Payment are as follows:
- People do not realise that they might be entitled to claim. It is accepted that you will be very distracted and upset at such a time so as not to think about financial matters at all.
- You may have been in contact with a health professional. That particular person may be too inexperienced to advise you. Even if things have been explained, were you able to take anything on board?
- Claim forms can be lengthy and complicated. This can lead to a form being completed incorrectly or, in the worst case, not at all.
- A health condition can make it impractical and/or uncomfortable. It can even stop a person from making a claim for Bereavement Payment. If your bereavement was caused by an accident, you may have been involved and injured as a consequence?

What if I have been refused a Bereavement Payment? Due to the inefficiencies of certain "officials" it has been known for refusals to be over-turned when the claim has been re-presented in a professional and methodical manner (i.e. by a professional company or consultant).
Many times, the refusal decision is based on an incorrect presentation of certain information by the claimant or by an incorrect assessment from the particular benefits office/r in question.
We have found 40% or more of "refused claims" have a very good chance of being overturned.
Needless to say, this issue is very important.
Full claim acceptance not only over-turns a previous refusal, but it also means you will probably be eligible for back-payments from the point of an initial claim.
This alone could often lead to a considerable back-payment for you.
