The widowed person must be aged 45 or over (but under state pension age) when their spouse or civil partner died.
You must have been legally married or in a registered civil partnership.
If you were in the process of divorcing or dissolving a civil partnership, you would still qualify for bereavement benefits of your spouse or civil partner died before the decree absolute or dissolution was issued
The allowance is suspended for any period when you are co-habiting with a same/opposite sex partner. If you re-marry or form a civil partnership, the benefit ceases.
