Attendance Allowance (AA)

What is Attendance Allowance?

Attendance Allowance is paid if you are a parent whose husband, wife or civil partner has died and you have at least one child for whom you receive Child Benefit.

The allowance is usually taxable.

To date, it is estimated that over £7 billion in benefits goes unclaimed every year - some of which should be claimed by Attendance Allowance applicants.

Case study

Sixty-eight year old Geoff lives with his wife.

Geoff worked for over forty years. Sadly, in the last ten years he has been suffering with a number of illnesses.

His condition has meant a daily intake of eighteen tablets as well as other prescription medicines. Luckily for Geoff, his wife has taken good care of him and ensured that he has taken his medication in accordance with the instructions given.

However, his wife is exhausted and the costs involved in meeting Geoff's needs are doing little to ease their worries. Travel to and from the medical practice, extra bedding requirements and occasional care costs have put a lot of strain on their budget.

Luckily, Geoff was put in touch with someone who was able to help him through the claims process for Attendance Allowance. He is now a happy recipient.

There is also further good news. The award of Attendance Allowance means that Geoff's wife is also entitled to Carers Allowance. On top of this, the couples Housing Benefit and Council Tax Benefit have also increased significantly.

This case study is fictitious, but helps to illustrate just some of the many ways in which Housing Benefit Helpline can help change peoples lives for the better.

Why does Attendance Allowance go unclaimed?

Many people who could claim Attendance Allowance often do not do so. The number of people who claim for the allowance is much lower when compared to other benefits and allowance that are available.

So why does not everyone claim Attendance Allowance?

Some of the reasons many people do not claim Attendance Allowance are as follows:

  • People do not realise that they might be entitled to claim. (You do not have to be "disabled" to claim Attendance Allowance!)

  • You may have been in contact with a health professional. That particular person may be inexperienced or too busy to assess your Attendance Allowance accurately, so may not be able to give you the best advice. This may lead to an unfair refusal, a reduced payment or wrong advice which may stop some genuine applicants starting their initial application

  • Patients' lack of awareness about benefits to which they may be entitled or how to claim them

  • Claim forms can be lengthy and complicated. This can lead to a form being completed incorrectly or, in the worst case, not at all

  • Staff at the DWP (previously known as DHSS/DSS) might have limited understanding about how you (or someone you know) are actually feeling

  • A health condition can make it impractical and/or uncomfortable. It can even stop a person from making a claim for Attendance Allowance. For example, a course of antibiotics or antidepressants can sometimes leave a claimant not in the best frame of mind to be completing a claim form adequately.

What if I have been refused Attendance Allowance?

Due to the inefficiencies of certain "officials" it has been known for refusals to be over-turned when the claim has been re-presented in a professional and methodical manner (i.e. by a professional company or consultant).

Many times, the refusal decision is based on an incorrect presentation of certain information by the claimant or by an incorrect assessment from the particular benefits office/r in question.

We have found 40% or more of "refused claims" have a very good chance of being overturned.

Needless to say, this issue is very important.

Full claim acceptance not only over-turns a previous refusal, but it also means you will probably be eligible for back-payments from the point of an initial claim.

This alone could often lead to thousands of pounds in back-payments due to you.
